Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India for issuance of writ of mandamus directing the second respondent to consider and pass orders on the final representation, dated 21.08.2015, seeking to restore the pay scale of the petitioner in the cadre of Middle School Headmaster w.e.f. 01.01.2011 onwards in the light of orders passed by this Court in W.A.No.210 of 2009 and Government Orders in GO(4D) No.10, School Education (D2) Department, dated 09.03.2012, within a reasonable time.

O R D E R

This writ petition is filed by Mrs.S.Josephine Pushparani, who is working as B.T.Assistant in the fourth respondent's School, seeking a writ of mandamus directing the second respondent to consider her representation, dated 21.08.2015, and to restore her pay scale in the cadre of Middle School Headmaster with effect from 01.01.2011 in the light of the Judgment, dated 30.04.2009, passed in W.A.(MD) No.210 of 2009, by the Hon'ble Division Bench of this Court and the Government Order in G.O.(4D) No.10, School Education (D2) Department, dated https://hcservices.ecourts.gov.in/hcservices/

09.03.2012, within a reasonable time.

2. Mr.T.S.Mohamed Mohideen, learned Additional Government Pleader, takes notice for the respondents. With the consent of both parties, this writ petition is taken up for final hearing at the admission stage itself.

3. Considering the limited scope of the relief sought for by the petitioner and the fact that her representation is pending before the third respondent for consideration, the third respondent is directed to consider the petitioner's representation, dated 21.08.2015, and forward the same to the second respondent if he finds any merit in the petitioner's representation. On receipt of the same, the second respondent is directed to consider the petitioner's representation and pass orders in the light of the Judgment, dated 30.04.2009, passed in W.A.No.210 of 2009, by the Hon'ble Division Bench of this Court and the Government Order in G.O.(4D) No.10, School Education (D2) Department, dated 09.03.2012, within a period of two months from the date of receipt of a copy of this Order.
