PRAYER :- For Bail in Crime No.138 of 2021 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner who was arrested and remanded to the Judicial custody on 22.04.2021 for the alleged offences under Section 304(ii) of IPC, in Crime No.138 of 2021 seeks bail.
2. The case of the prosecution is that the petitioner said to have drove his four-wheeler in a rash and negligent manner and dashed against the husband of the defacto compalainant and two others. Hence the complaint.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner was in judicial custody from 22.04.2021. Hence, he prays for grant bail to the petitioner.

4. The learned Government Advocate (Crl.side) would submit that due the petitioner's rash and negligent driving, the husband of the
defacto complainant and two others died on the spot. Hence, he vehementaly opposed for grant of bail to the petitioner.
5. Taking into consideration, the grave nature of offence committed by the petitioner and the investigation is at the nascent stage and also the fact that the petitioner was arrested only on 22.04.2021, this Court is not inclined to grant bail to the petitioner.
