PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 1st respondent to direct the respondents Nos.3 and 4 to initiate actions against the 6th respondent under section 133 of Cr.P.C based upon the representation dated 26.02.2024 consequently direct the 5th respondent to provide police protection for invoking provisions under section 133 of Cr.P.C by the 3rd and 4th respondents within stipulated time fixed by this Court.

ORDER

This writ petition has been filed for a mandamus directing the 1st respondent to direct the respondents Nos.3 and 4 to initiate action against the 6th respondent under section 133 of Cr.P.C based upon the representation dated 26.02.2024 consequently direct the 5th respondent to provide police protection for invoking provisions under section 133 of Cr.P.C by the 3rd and 4th respondents within stipulated time fixed by this Court.

2. Heard the learned counsel for the petitioner, learned Additional Government Pleader and the learned Government Advocate for the official respondents.

The petitioner's case is that the branches of the coconut trees belonging to the 6th respondent are entering into the petitioner's household through the windows thereby obstructing the free flow of air and screening the sunlight. Therefore, the petitioner preferred a representation dated 26.02.2024 to the first respondent to take against the 6th respondent under Section 133 of the Code of Criminal Procedure for the nuisance caused. However, the said representation is pending so far without any action and hence, the petitioner is before this Court.

4. The learned Additional Government Pleader, on instructions from the officials present in the Court, would submit that on considering the representation of the petitioner, the branches have been removed by the officials. The said submission is recorded. 3/5
