Respondent PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the learned Judicial Magistrate-II, to dispose of the Criminal Case in S.T.C.No.134 of 2017 under Section 200 Cr.P.C and under Sections 138, 142 of the Negotiable Instruments Act dated 21.12.2017 on the file of the Judicial Magistrate-II, Madurai within the time stipulated by this Court.

O R D E R

This petition has been filed to direct the learned Judicial Magistrate-II, to dispose of the Criminal Case in S.T.C.No.134 of 2017 under Section 200 Cr.P.C and under Sections 138, 142 of the Negotiable Instruments Act dated 21.12.2017 on the file of the Judicial Magistrate-II, Madurai within the time stipulated by this Court.

2. The case of the petitioner is that he is the defacto complainant in S.T.C No.134 of 2017 on the file of the learned Judicial Magistrate No.II, Madurai, which was registered for the offences punishable under Sections 138 and 142 of the Negotiable Instruments Act. The grievance of the petitioner is that even after lapse of three years, so far the trial has not been completed. Hence, this petition.

3.Considering the facts and circumstances of the case and also taking note of the fact that the occurrence took place in the year 2016 and the case is of the year 2017, there shall be a direction to the learned Judicial Magistrate No.II, Madurai to expedite the trial and dispose of the case in S.T.C.No.134 of 2017 within five months from the date of receipt of a copy of this order. The compliance report shall also be submitted to the Registry of this Court.
