ORDER

This petition is filed to direct the 2nd respondent not to harass the petitioner and his brother based on his representation dated 16.03.2023. 1/4

2. When the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondent police submitted that based upon the complaint given by the third respondent against the petitioner enquiry was undertaken. During the course of enquiry, the petitioner also given a complaint against the third respondent. He further submitted that in both the cases, enquiry is going on.

4. Since a complaint has been given against the petitioner by the third respondent, it is the duty of the petitioner to co-operate with the enquiry officer to complete the investigation. Question of harassment may not arise at this stage.

5. In view of the above submission made by the learned Additional Public Prosecutor, the second respondent is directed to complete the enquiry in both the cases within a period of two months from the date of receipt of copy of this order. Depending upon the outcome of the enquiry, the parties are directed to workout their remedy through the appropriate proceedings. With the above directions, this Criminal Original Petition is disposed of.
