ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 17 ofTNK (RT) Order 1973 read with 7(i) a (ii) of E.C.Act, 1955, in Crime No.69 of 2018 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that on secret information that there is abduction of the ration good from Karur to Coimbatore road, they conducted check up and they found that the petitioner stood near one Arumugam Grocery shop with four plastic canes and when he saw the respondent, he tried to fly away from the spot and he was caught hold by the respondent and on search, the respondent found that the canes were filled with 120 litres of kerosene, which was bought from the people for selling the same for higher price in his shop. Hence, the complaint.

3.The learned counsel appearing for the petitioners would submit that the petitioner is an innocent person and he has been falsely implicated in this case.

4.The learned Government Advocate (criminal side) would submit that the investigation is pending and no previous case as against the petitioner.

5.Taking note of the facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.1, Karur and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police, as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously. 6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
