For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR BAIL Under Sec.439 of Cr.P.C PRAYER :- Bail in Crime No.139 of 2021 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioners, who were arrested on 17.02.2021 for the alleged offences punishable under Section 302 IPC in Crime No.139 of 2021, seek anticipatory bail.

2.The case of the prosecution is that on 14.02.2021, at about 11.45 am., when the defacto complainant's maternal uncle, returning his home, some unknown persons attacked him with deadly weapons. Due to which, the uncle of the defacto complainant died. Hence, the complaint.

3.The learned counsel for the petitioners submitted that the petitioners are innocent persons and the petitioners' name were not found in FIR. He further submitted that they are in custody from 17.02.2021.

4.The learned Government Advocate(Crl.side) submitted that after investigation, the involvement of the petitioners herein came to light. He further submitted that the accused persons engaged coolies to murder the deceased and the second petitioner paid a sum of Rs.80,000/- to the henchmen. He also submitted that the second petitioner is having two previous cases and the first petitioner has no previous case.

5.It is seen that the accused persons engaging coolies to murder the deceased. The nature of offence is very cruel and therefore, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
