When the matter was taken up for hearing on 26.11.2021, there was no representation for the petitioner. Even today (i.e,15.12.2021), there is no representation for the petitioner. At this juncture, the learned Government Advocate (Criminal Side) would submit that the respondent police has filed the final report as 'mistake of fact' and that RCS Notice has also been served on the complainant.

2.Considering the fact that FIR was closed as 'mistake of fact', nothing survives for further adjudication in this petition. Hence, the Criminal Original Petition is dismissed as infructuous.
