For Respondent : Mr.S.Ravi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime No.6/2021 on the file of the respondent police ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 494 and 498(A) of IPC and Section 4 of DP Act in Crime No.6 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that due to the matrimonial dispute, the wife of the petitioner left the matrimonial house. Subsequently, the petitioner got married with one Jayanthi. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and a false complaint has been lodged against him.

4. The learned Additional Public Prosecutor appearing on behalf of the respondent police submits that on previous occasion, the petitioner has moved a petition in Crl.OP(MD)No.5316 of 2021, which was dismissed as not pressed.

5. On perusal of the affidavit filed in support of this petition, there is no mention with regard to the previous petition filed by this petitioner. When enquiry was made by this Court, the learned counsel for the petitioner would submit that, at that time, there was a submission on the side of the respondent that, no case has been registered against the petitioner. Hence, the petition was withdrawn by the petitioner. In such circumstances, the learned counsel seeks liberty to file a fresh petition setting out all the details.

6. In view of the above, the petitioner is at liberty to file a fresh petition giving proper details. Giving such liberty, this petition is dismissed.
