PRAYER :- For Bail in Crime no.578 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner, who was arrested on 30.11.2023, for the offence under 1/3

Sections 8(c), r/w 20(b) (ii) (A) & 22(c) of Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.578 of 2023, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner along with the other accused persons were in possession of 550 gms of Diazepam powder and 700 gms of Ganja.

3.The learned counsel appearing for the petitioner submits that this is the second bail application filed by the petitioner. The first bail petition filed by the petitioner has been dismissed by this Court on 28.02.2024. The petitioner is languishing in jail from 30.11.2023.

4.The learned Additional Public Prosecutor appearing for the respondent strongly opposes for grant of bail to the petitioner and submits that the contraband involved in this case is a commercial quantity. 5.Considering the nature of allegations, the quantity of contraband involved in this case and since there is no change in circumstances after the 2/3
