ORDER : The Court made the following order :- The petitioner, who is arrayed as sole accused, apprehending arrest at the hands of the respondent police for the offence punishable under Sections 4(1)(aa) and 4(1-A) of Tamil Nadu Prohibition Act, in Crime No.396 of 2021, on the file of the respondent Police, seeks anticipatory bail.

2.The case of the prosecution is that on 11.03.2021, when the defacto complainant inspected the petitioner's shop, he was in possession of 171 liquor bottles illegally. Hence, the case has been registered.

3.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

4.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD).No.6401 of 2021 any offence as alleged by the prosecution and has been falsely implicated in this case.

5.The learned Additional Public Prosecutor, on instructions, submitted that the petitioner was in possession of 171 liquor bottles illegally. He further submitted that the petitioner is also having one previous case, and hence, he strongly opposed to grant anticipatory bail to the petitioner.

6.In view of the fact that the petitioner was in possession of 171 liquor bottles illegally and he is also having one previous case, this Court is not inclined to grant anticipatory bail to the petitioner.
