: Respondents PRAYER: Writ Petition - filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the respondents herein to permit the petitioner to ply petitioner's Mini Bus bearing Registration No.TN 29 N 0255 Vallaithottam Bus Stand to Marthandam Bus Stand route by stopping the said Mini Bus at Karungal Bus Stand as per G.O.Ms.No.136, Home (Transport-III) Department dated 23.02.2011 and G.O.Ms.No.146, Home (Transport-III) Department dated 25.02.2011.

O R D E R

This writ petition appears prima facie infructuous, since it relates to relief sought for in respect of a mini bus permit which is itself for the period between 30.11.2005 to 29.11.2015 only.

2.The matter has been listed on three occasions at the request of the petitioner to seek instructions. But even today, the petitioner has not obtained instructions as to whether anything survives in the matter. The Government has also not bothered to file a counter till date, despite notice having been issued as early as on 04.12.2014. In the light of the aforesaid, I am not inclined to keep the matter pending in the docket of the Court any longer.

3.The Writ Petition is dismissed as infructuous. Liberty is granted to the petitioner to approach this Court, if the mini bus permit has been extended and the cause of action still survives. No costs. Consequently, the connected miscellaneous petition is closed.
