Respondents This Writ Petition has been filed under Article 226 of the Constitution of India praying for a Writ of Mandamus to direct the 2nd respondent to recover the amount of Rs. 84,148/- by invoking the Revenue Recovery Act and sent the so collected amount to the petitioner as directed by the 1st respondent vide his proceedings in Roc.No.4474/2013/D3 dated 10.09.2013 within the period that may be stipulated by this Honourable Court. ORDER
The petitioner has come forward with this Writ Petition praying for a Writ of Mandamus to direct the 2nd respondent to recover the amount of Rs. 84,148/- by invoking the Revenue Recovery Act and sent the collected amount to the petitioner as directed by the 1st respondent vide his proceedings in Roc.No.4474/2013/D3 dated 10.09.2013 within the period that may be stipulated by this Court.
2. Originally, the petitioner was appointed as an appraiser in the respondent Cooperative Bank. On an allegation, he was dismissed from service of the respondent Bank. He claimed back wages from the respondents. The learned counsel for the https://hcservices.ecourts.gov.in/hcservices/
petitioner would submit that the first respondent vide his proceedings dated 10.09.2013 has authorized the second respondent to collect the amount of Rs.84,148/- due to the petitioner by invoking the provision of the Revenue Recovery Act. Inspite of the same, no action has been taken by the respondents. Hence, he sought for the relief stated supra.
3. On noticing the above-said submission, the learned Govt.Advocate would submit that necessary steps would be taken to recover the amount in question within the time stipulated by this Court.
4. In view of the above, the second respondent is directed to comply with the directions of the first respondent dated 10.09.2013 within a period of six weeks from the date of receipt of a copy of this order.
5. This Writ Petition stands disposed of accordingly. No costs.
