19823 of 2025 in the above Second Appeal and to restore the same.

2. I have gone through the affidavit filed in support of the petition and I am satisfied with the reasons that the petitioners have made out sufficient grounds for allowing the present application. Notice was not even ordered in CMP(MD) No. 19823 of 2025, at which stage it came to be dismissed. I do not see any requirement to order notice in the present application.

3. Hence, this CMP is allowed, and the order dated 18.02.2026 passed in CMP(MD) No. 19823 of 2025 in the above Second Appeal is restored, and the Registry is directed to post it on 22.04.2026. 02.04.2026 trp 1/1 https://www.mhc.tn.gov.in/judis
