For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in crime No.141/2021 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/A3, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 379 of IPC r/w 21(1) of Mines and Minerals (Development and Regulation) Act 1957 in Crime No.141 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with the co-accused said to have illegally transported one unit of river sand in a TATA Ace vehicle bearing Registration No.TN-59-AE-3115 on 20.04.2021.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in the present case and hence, he seeks anticipatory bail. 4.The learned Government Advocate (Criminal side) for the respondent strongly opposed this petition.

CRL OP(MD). No.7342 of 2021 5.This is the second anticipatory bail application and the earlier petition was dismissed by this Court on 26.04.2021 in Crl.O.P.(MD)No.5902 of 2021.

6.Taking note of the fact that there is no change in circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner.
