PRAYER :- For Bail in Crime No.04 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner is arrayed as sole accused. He was arrested and remanded to Judicial Custody on 13.04.2021 for the offences punishable under sections 7(a) of Prevention of Corruption Act 1988 as amended by Act 16 of 2018 in Crime No.04 of 2021 on the file of the respondent police. He seeks bail.

2.The case of the prosecution is that the de-facto complainant is a farmer and he is doing paddy crops in his lands and his relative lands. On 26.03.2021, the de-facto complainant approached the petitioner for procurement of 450 paddy, at the time, the petitioner informed to the complainant that the Government fixed the rate is per KG Rs.19.58/- and he demanded huge money as bribe. Later on 10.04.2021, again the de-facto complainant approached the petitioner, the petitioner demanded Rs.26,400/-.The de-facto complainant requested him to reduce the said amount and based on which, the petitioner agreed and reduced the amount of Rs.16,400/-. CRL OP(MD). No.6414 of 2021 respondent police. The respondent police observed the petitioner's activities and tainted money from the petitioner at Theppakulam Madurai. Hence, the complaint.

3.The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case and he is in judicial custody from 13.04.2021. Hence, he seeks bail.

4.The learned Government Advocate (Criminal side) strongly opposed this petition on the ground that during trap proceedings, the petitioner was arrested and tainted money was also recovered from him and that the investigation is at the preliminary stage. 5.Considering the nature of the offence is very serious and also considering the fact that the investigation is at the preliminary stage, this Court is not inclined to grant bail to the petitioner.
