This Petition has been filed seeking to withdraw and transfer the HMOP No. 29 of 2023, on the file of Sub Court, Thiruchendur to Sub Court, Ambasamudram.

2.The brief facts are as follows:

The marriage between the parties was solemnized on 21.11.2021. At the time of marriage the petitioner's parents gave 30 sovereigns of gold jewels as dowry. The respondent is a divorcee. This is second marriage to him. But after some, the respondent make quarrel with the petitioner. At last, the petitioner was sent out from the matrimonial home. Thereafter, he filed the above said H.M.O.P. before the Sub Court, Tiruchendur. Now she is residing at Kallidaikurichi along with her parents. Hence, she is unable to attend every hearing at Tiruchendur. Hence, she seeks transfer of the same to the Sub Court, 3.Heard the learned counsel for the petitioner. Even though the respondent was served with notice, none appears on behalf of him. His name was also printed in the cause list.

4.Considering the facts and circumstances of the case and considering the convenience of the wife, the H.M.O.P.No.29 of 2023 filed by the respondent on the file of the Sub Court, Tiruchendur, is 2/4

ordered to be withdrawn and transferred to the Sub Court, 5.With the above said directions, this petition stands allowed. No costs. Consequently, connected miscellaneous petition is closed. 29.02.2024 NCC :
