This writ petition is filed seeking a direction to the first respondent to dispose of the appeal filed by the petitioner on 18.11.2024 at the earliest point of time in the interest of justice.

2. The learned counsel for the petitioner submits that the petitioner appeared in the selection process for the post of Grade II Police Constable. The petitioner succeeded in the selection of Grade II Police Constable. During the verification, it is found that he is involved in some criminal cases. Accordingly, the third respondent issued proceedings, dated 05.11.2024 rejecting the petitioner's candidature for appointment as Grade II Police Constable. Aggrieved by the said order, he submitted an appeal petition before the first respondent on 18.11.2024. Aggrieved by the inaction of the first respondent in considering the same, the present writ petition is filed. 2/6

3. The learned Additional Government Pleader appearing for the respondents, on instructions, submits that against the order of the third respondent, dated 05.11.2024, no statutory appeal lies. If the petitioner intends to challenge the same, he has to challenge the same by filing writ petition. It appears that without knowing the procedure, the petitioner submitted a representation to the first respondent on 19.11.2024 and he is under impression that it is an appeal. The learned Additional Government Pleader further submits that the first respondent forwarded the said representation to the third respondent vide memorandum in R.C.No.8950346/Rect.1(2)/2024, dated 26.12.2024 requesting to take further action. The learned Additional Government Pleader also placed a copy of the memorandum, dated 26.12.2024 before this Court

4. In view of the submission made by the learned Additional Government Pleader, it appears that the issue is pending with the third respondent and he has to take appropriate decision as per the instructions issued by the first respondent.

In view of the same, in our considered view, it is appropriate and reasonable to dispose of this writ petition at the admission stage with the consent of both sides without going into the merits of the case with a direction to the third respondent to consider and pass appropriate orders on the representation, dated 18.11.2025 of the petitioner in accordance with law and communicate the same to the petitioner within a time stipulated herein to meet the ends of justice.

Accordingly, this writ petition is disposed of with a direction to the third respondent to consider and pass appropriate orders on the representation, dated 18.11.2024 of the petitioner in accordance with law and communicate the same to the petitioner within a period of four weeks from the date of receipt of a copy of this order.

No costs.
