O R D E R

This petition has been filed seeking a direction to the Assistant Sessions Court, Padmanabhapuram to expedite the trial in S.C.No.8 of 2017 within a stipulated time.

2. The petitioner is an accused in Crime No.71 of 2016 for the offences under Sections 294(b), 307 and 506(ii) of I.P.C., and even though the matter was taken cognizance and committed to the Court of Sessions in the year 2017, for the past two years there is no progress in the trial. Hence, the present criminal original petition has been filed.

3. The learned Government Advocate (Crl.side) on instructions would submit that the petitioner did not appear before the trial Court and hence, Non-Bailable Warrant was issued against him and the same is pending for more than one year and now only the same has been recalled. For his non-appearance, the accused cannot blame the Court as if the Court is holding the matter.

4. Be that as it may, considering the fact that the matter is pending from the year 2017, the learned Assistant Sessions Judge, Padmanabhapuram is directed to proceed with the trial in S.C.No.8 of 2017 and dispose of the same within a period of six months from the date of receipt of a copy of this order.

5. With the above direction, this criminal original petition is disposed of.
