For Respondent : Mr.S.Ravi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.116 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Section 147, 148, 323, 324, 294 (b), 448, 506 (ii) of IPC and Section 3 of TNPPDL Act in Crime No.116 of 2021, seek anticipatory bail.

2. The case of the prosecution is that the petitioners and three others entered into Thevaram Government Primary Health Centre with weapon and attacked one Surya Prakash and others and damaged the Hospital properties. Hence, the complaint. 3.The learned counsel for the petitioners would submit that the petitioners are innocent persons and a false complaint has been lodged against them.

CRL OP(MD). No.6422 of 2021 4.The learned Government Advocate (Crl. Side) appearing for the respondent Police submitted that the injured has been discharged from the hospital and that the investigation is going on. He would further submit that the accused 2 and 5 have already moved anticipatory bail petition in Crl.OP(MD)NO.5369 of 2021 and the same was dismissed on 16.04.2021.

5. Considering the seriousness of the allegations that have been levelled against the petitioners and also considering the fact that the petitioners are also involved in major offences the discretionary relief of anticipatory bail cannot be granted in favour of the petitioners.
