PRAYER :- For bail in Crime No. 195 of 2021 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner who was arrested and remanded to the Judicial custody on 19.04.2021 for the alleged offences under Sections 379 of IPC and r/w section 21(4) of Mines and Minerals (Development and Regulation Act) 1957 in Crime No.195 of 2021 seeks bail.

2. The case of the prosecution is that on 19.04.2021 at about 07.00 a.m, the petitioner has illegally transported the 3 bags sand by his two wheeler vehicle. Hence the compliant.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner was in judicial custody from 19.04.2021. Hence, he prays for grant bail to the petitioner.

4. The learned Government Advocate (Crl.side) would submit that on 19.04.2021 at about 07.00 a.m, when the respondent police made routine ride. While the petitioner has illegally transported the 3 bags sand by his two wheeler vehicle. Hence, he vehementaly opposed for grant of bail to the petitioner.

5. Considering the facts that there is one previous case pending against the petitioner, this Court is not inclined to grant of bail to the petitioner.
