ORDER : This Court made the following order :- The petitioner, who was arrested and remanded to judicial custody for the offences punishable under Sections 8(c), 20(b)(ii) (C), 25 and 29(1) of NDPS Act, in Cr.No.395 of 2024 on the file of the respondent police, seeks bail. The petitioner is in judicial custody from 09.10.2024.

2. The case of the prosecution is that the petitioner and other accused was illegal possession of 50 kgs of ganja. Hence, this case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he is falsely implicated in this case. The petitioner is in judicial custody for more than one year. Hence, he seeks bail.

4. The learned Additional Public Prosecutor for the respondent submitted that totally, 50 kgs of contraband was 2/5

recovered from the accused persons, which is commercial quantity. Further he submitted that the petitioner has one previous case which is similar in nature. Hence, he opposed for grant of bail to the petitioner.

5. Considering the facts and circumstances of the case and also considering that the quantity of the contraband is commercial, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this criminal original petition stands dismissed.
