PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of MANDAMUS directing the respondents to re-fix the seniority of the petitioner on the basis of the marks secured by him in the Police Recruitment School in accordance with Rule 24 of the Tamil Nadu Special Police Subordinate Service Rules, 1978, on par with the benefit extended to similarly placed persons pursuant to the orders passed by this Honble Court in W.P. (MD). No. 7266 of 2020 dated 11.10.2022 and consequently, directing the respondents to consider the petitioner for promotion to the post of Assistant Commandant by placing him above his junior P. Sekar with all consequential service and monetary benefits.

The present writ petition is filed for a mandamus to direct the respondents to re-fix the seniority of the petitioner on the basis of the marks secured by him in the Police Recruitment School in accordance with Rule 24 of the Tamil Nadu Special Police Subordinate Service Rules, 1978, on par with the benefit extended to similarly placed persons pursuant to the orders passed by this Court in W.P. (MD). No.7266 of 2020 dated 11.10.2022 and consequently, direct the respondents to 2/5

consider the petitioner for promotion to the post of Assistant Commandant by placing him above his junior P. Sekar with all consequential service and monetary benefits.

This Court, without expressing any opinion on merits, directs the respondents to consider the petitioner's claim in the light of the order dated 11.10.2022 in W.P.(MD) No.7266 of 2020 and by following the Tamil Nadu Special Police Subordinate Service Rules, 1978, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
