The writ petition is filed seeking a direction to the first respondent to consider the petitioner's representation dated 23.02.2023 and restore the patta No.502 in the name of the petitioner in respect of the property situated in Survey No.359/3, measuring 0.33 acres (82 cents) in Kongampatti Village, Melur Taluk, Madurai District.
2. Learned counsel appearing for the petitioner would submit that the subject property is situated at No.26, malampatti as per the Patta No. 502 and the name of the village is wrongly mentioned as Kongampatti Village in the writ prayer. The said statement is recorded.
3. It is the case of the petitioner that he purchased the subject property under sale deed dated 23.12.1998 from one Muthu Mohamed @ Muthukaalai, Muthalibu and Kadar Maiden. The vendors of the petitioner in turn got the property under assignment in the category of 'non-panjamar landless poor individuals' in Ref-Dkt No.2797-79 dated 30.04.1970. The patta for the subject property was issued in the name of the petitioner in Patta No.502. Later, without notice to the petitioner, the revenue records were reclassified and subject property was mentioned as Panjamar Tharisu. Therefore, the petitioner submitted the instant representation before the first respondent on 23.02.2023 seeking restoration of patta in the name of the petitioner. The same has not been considered. Hence, the petitioner has come before this Court.
4. Learned Additional Government Pleader who appeared for the respondents would submit that similar request made by the petitioner before the second respondent was rejected by him by his order dated 24.11.2024.
Thereafter, the petitioner submitted the instant representation before the first respondent and the same will be considered in accordance with law.
5. In view of the same, without expressing any opinion on the merits of the matter, the first respondent is directed to consider the representation of the petitioner dated 23.02.2023 and pass final orders within a period of twelve weeks from the date of receipt of a copy of this order, after affording reasonable opportunity to the petitioner.
6. With the above direction, this Writ Petition is disposed of. No costs.
