For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PRAYER :- For Anticipatory Bail in Crime No. 402 of 2021 on the file of the respondent Police ORDER : The Court made the following order :- Apprehending arrest at the hands of the respondent police for the alleged offences punishable under sections 294(b), 427 and 506(ii) IPC, in Crime No.402 of 2021, on the file of the respondent police, the petitioner has come forward with this petition seeking anticipatory bail.

2.It is seen from the submissions made that on 13.04.2021, at about 9.30 a.m., when the defacto complainant and his friendKaviyarasan were waiting near TASMAC, in his two wheeler bearing Registration No. TN-48-AY-3222-Pulsar 150, the petitioner and other accused came there and enquired them as to whether they belong to Melakondayampettai. When answered in affirmative , they scolded them in filthy language and the accused-Vasant hit his two wheeler with pattakathi. He also attacked one Kaviyarasan by using pattakathi and he suffered injury. The defacto complainant was also attacked and therefore, this case came to be filed.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case and the injured has been discharged from the hospital. He also https://hcservices.ecourts.gov.in/hcservices/

submitted that co-accused in this case was already arrested and released on bail.

4.The learned Government Advocate (criminal side) opposed this petition on the ground that the petitioner has four previous cases and he is a history sheeter.

5.Taking note of the fact that the petitioner has four previous cases and almost all the cases involved in causing injuries to the victim and also the fact that the petitioner is a history sheeter, this Court is not inclined to grant anticipatory bail to the petitioner.
