The present Petition has been filed by the accused persons in Crime No.590 of 2020, on the file of the first respondent-Police seeking to quash the FIR, wherein, the Petitioners are alleged to have committed the offence under Section 160 of IPC. 2.A perusal of the FIR reveals that two groups of people who are shown as A-Group and B-Group standing in the road and fighting with each other causing nuisance to the general 2/5
public, despite warning from the Police authorities. 3.The learned counsel for the Petitioners submitted that maximum punishment for the offence under Section 160 of IPC is one month and so far charge-sheet has not been laid and hence the Petitioners are entitled to the benefit under Section 468 Cr.P.C. 4.The learned Government Advocate(Crl.side) appearing for the first respondent- Police submitted that so far charge sheet has not been laid.
5.Considering the above facts, it is pleaded that so far charge sheet has not been laid for the offence that has taken place on 3.5.2020 and hence, the Petitioners are entitled to the benefit under section 468(2)(b) of Cr.P.C.
6.In view of the above said fact, FIR in Crime No.590 of 2020, on the file of first respondent-Police as against the Petitioners is quashed and the Criminal Original Petition stands allowed. Consequently, connected Miscellaneous Petition is closed. 30.03.2026 NCS : Yes/No 3/5
