O R D E R

This Criminal Revision Case has been filed with the following prayer:

"to call for the records and set aside the order passed in Crl.M.P.No.2396 of 2018 in C.C.No.7 of 2018, dated 14.11.2018 on the file of the learned Judicial Magistrate No.III (CCIW), Madurai by allowing the Criminal Revision Petition."

2.The Co-ordinate Bench of this Court, vide order, dated 06.06.2023, had dismissed the above Criminal Revision Case with the following directions:

"13.Accordingly, the Criminal Revision Case is dismissed. However, considering the age of the petitioner, this Court is inclined to dispense with the personal appearance of the petitioner. Accordingly, the personal appearance of the petitioner is dispensed with and he shall be represented by a counsel after filing an appropriate application. However, the petitioner shall be present before the Court at the time of furnishing of copies, framing charges, questioning under Section 313 Cr.P.C. and at the time of passing judgment. The trial Court is directed to complete the trial within a period of six months from the date of receipt of a copy of this order."

3.Today, the Criminal Revision Case is listed under the caption "Extension of time for lower Court".

4.From the perusal of the records, it is transpired that the Coordinate Bench of this Court, vide order, dated 06.06.2023, had directed the learned Judicial Magistrate No.III (CCIW), Madurai, to complete the trial in C.C.No.7 of 2018 within a period of six months from the date of receipt of a copy of the order. However, the trial Court did not complete the trial within the time granted by the Co-ordinate Bench of this Court. Thereafter, the learned Judicial Magistrate No.III (CCIW), Madurai, vide letter D.No.46/2024, dated 14.02.2024, sought further time and the Coordinate Bench of this Court, vide order, dated 11.03.2024, directed the learned Judicial Magistrate No.III (CCIW), Madurai, to dispose of the case in C.C.No.7 of 2018 as expeditiously as possible. 5.Again, the learned Judicial Magistrate No.III (CCIW), Madurai, vide letter D.

No.940/2024, dated 19.11.2024, expressed his inability to complete the trial and to dispose of the case in C.C.No.7 of 2018 and sought one year further time for disposal of the said case. The Coordinate Bench of this Court, considering the reasons assigned by the learned Judicial Magistrate No.

10.12.2024, had granted nine months further time to complete the trial and to dispose of the case in C.C.No.7 of 2018. Again, the learned Judicial Magistrate No.III (CCIW), Madurai, vide letter D.No. 1376/2025, dated 20.09.2025, seeks extension of time to complete the trial and to dispose of the case in C.C.No.7 of 2018. 6.It appears that the learned Judicial Magistrate No.III (CCIW), Madurai, is not complying with the directions issued by this Court. Whereas, already extension of time was granted several times and initially, the Co-ordinate Bench of this Court, vide order, dated 06.06.2023, had directed the learned Judicial Magistrate No.III (CCIW), Madurai, to complete the trial in C.C.No.7 of 2018 within a period of six months.

More than two years period have passed and still, the trial has not been completed, which is very serious matter. 7.Accordingly, considering the request made by the learned Judicial Magistrate No.III (CCIW), Madurai, this Court, as a last opportunity, grants six months further time from the date of receipt of a copy of this order to complete the trial in C.C.No.

granting any unnecessary adjournment to either of the parties, unless there is any cogent reason or stay by any higher Court and also proceed the matter on a day-to-day hearing basis.

8.The Registry is directed to communicate this order to the learned Principal District Judge, Madurai as well as to the learned Judicial Magistrate No.III (CCIW), Madurai, within a period of one week from today without fail for their necessary information and communication. 30.10.2025 cmr To 1.The Principal District Judge, Madurai.
