PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents to consider the petitioner representation dated 22.01.2020 and consequently direct the 2nd respondent to Survey in his Punjai Land in Survey No. 735/1 vide in Patta No.303 of Kadayanallur Village, Tenkasi Taluk and District.

ORDER

This writ petition is filed to direct the respondents to issue separate patta in favour of the petitioner, by surveying the land in S.No.735/1 situated at Kadayanallur Village, Tenkasi Taluk and District.

2.According to the petitioner, he made a representation dated 22.01.2020 to the respondents with the relief sought for in the prayer. So far, no action has been taken by the respondents. Hence, the petitioner is before this Court.

3.The learned Special Government Pleader appearing for the respondents 1 and 2 would submit that the petitioner has not paid necessary charges to the respondents to measure the aforesaid property and to issue separate patta in favour of him, as per rules. If the petitioner submits fresh application through on-line along with necessary charges before the respondents to workout his remedy, the same shall be considered on merits and in accordance with law. 4.In reply, the learned counsel appearing for the petitioner https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.8384 of 2020 would submit that liberty may be given to the petitioner to submit fresh application, by paying necessary charges, through on-line to workout his remedy before the respondents.

5.By recording the submissions made by the learned counsel on either side, this Writ Petition is disposed of with such liberty. No costs.
