Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of Mandamus to direct the first and second respondents i.e. the Managing Director, Tamilnadu Housing Board, Chennai and the Executive Engineer & Administrative Officer, Madurai Housing Unit, Ellis Nagar, Madurai to dispose of petitioner's representation dated 29.10.2014 regarding refund of the amount of Rs.50,000/- collected from him, within a specified time frame that may be fixed by this Hon'ble High Court.

Mr.Nagarajan, learned Standing counsel for the respondent Board, takes notice for the respondents.

2. By consent, the writ petition is taken up for disposal.

3. The petitioner seeks for a mandamus directing the first respondent to dispose of his representation dated 29.10.2014 through which, he has sought for refund of the amount of Rs.50,000/- collected from him.

4. It is the contention of the petitioner tha the said amount of Rs.50,000/- was recovered from his salary on the ground that he has not calculated the interest amount due from one individual, who purchased the HIG flat. It is the further case of the petitioner that the said individual, namely, Subburaj has subsequently remitted the interest amount and therefore, the petitioner is entitled to get back the said sum of Rs.50,000/- recovered from his salary. Seeking for refund of such amount, the petitioner has already made a representation on 29.10.2014 and therefore, it is for the first respondent to consider the request and pass orders on the same on merits and in accordance with law. https://hcservices.ecourts.gov.in/hcservices/

Accordingly, this writ petition is disposed of only with a direction to the first respondent to consider the representation of the petitioner dated 29.10.2014 and pass appropriate orders on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.
