Respondents PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the records of the impugned order passed by the 3rd respondent letter dated 16.12.2025 and quash the same and consequently direct the respondents to pay the retirement benefits namely leave encashment Rs.11,321/-and Gratuity of Rs.5,79,936/- a total sun of Rs.5,91,257/- together with interest at 12% amounts from the date of retirement i.e., 31.05.2022 till the payment is made within the stipulated time fixed by this Court.

ORDER
The relief sought for in the present writ petition is against an order passed by the third respondent herein, who is the Secretary of the Co-operative Society. A preliminary objection is raised on the maintainability of the writ petition by placing reliance on various decisions.

This Court had an occasion to consider the same aspect of maintainability of a writ petition against Co-operative Society for grant of release of terminal benefits in WP(MD)No.10408 of 2026 and came to the conclusion that the writ petition seeking release of terminal benefits against Co-operative Society is not maintainable.
3. In the light of the order passed in the said writ petition, this Court is not inclined to entertain the present writ petition as well for the same reasons. However, liberty is granted to the petitioner to file a revision petition under Section 153 of Tamil Nadu Co-operative Societies Act, 1983 before the Registrar of Co-operative Societies, Chennai within a period of three weeks from the date of receipt of a copy of this order and in case, if any such revision petition is filed by the petitioner within the time stipulated, the Registrar of Co-operative 2/4
Societies, Chennai shall entertain and dispose of the same on merits in accordance with law as expeditiously as possible within a period of twelve weeks from the date of filing of the said revision petition by the petitioner after affording an opportunity of hearing to the petitioner.
