ORDER

This petition has been filed to quash the First Information Report in Crime Number 4/2021, under Sections 406, 420, 447 and 506 (ii) IPC on the file of the first respondent Police. 2.When the matter was taken up for hearing on 16.08.2021, it was reported that the matter has been compromised between the parties and first instalment amount was also paid to the defacto complainant and the second and third instalment amount remain to be paid.

3.Today (25.10.2021), the learned counsel for the petitioner would submit that because of freezing of Bank account, he is not in a position to settle the above said two instalments. 4.The learned counsel for the second respondent would submit that subsequently, the account has been defreezed, even then, the petitioner is not in a position to settle the amount. https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P(MD)No.7830 of 2021 and 5.The learned Government Advocate would submit that investigation has been completed and final report was filed before the Judicial Magistrate Court No.II, Trichy and taken on file in CC No.938 of 2021 and posted to 18.11.2021 for the appearance of the accused persons.

6.Since the matter has been taken cognizance by the concerned Court, this petition has become infructuous. Accordingly, this Criminal Original Petition is disposed of infructuous. Consequently, connected Miscellaneous Petition is closed.
