PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the respondents to take action on the petitioner's application dated 06.01.2026 seeking to transfer him in the post of Special Grade Foreman for the vacancy arisen due to the superannuation of Mr.Arivalagan working in the office of the Assistant Engineer, Tirumangalam Town / Section, Tirumangalam Division, Madurai within a time frame fixed by this Court.

Mr.B.Ramanathan, learned Standing Counsel, takes notice for the respondents.

2. With the consent of both sides, this writ petition is disposed of at the admission stage.

3. Heard the learned counsel for the petitioner and the learned Standing Counsel appearing for the respondents.

4. The case of the petitioner is that he was initially appointed as Field Assistant on 11.07.1997. Thereafter, he was promoted from time to time and finally promoted to the post of Foreman / Electrical / Special Grade-I on 30.03.2013 and working as such as on date in the Office of the Assistant Engineer (O&M), Panaiyur, Madurai Electricity Distribution Circle, since 23.02.2024. On coming to know that the post of Special Grade Foreman at Thirupparankundram is going to fell vacant on 30.06.2025 on superannuation of the incumbent employee, the petitioner claimed to have submitted an application on 17.06.2025 to the first respondent requesting for his transfer to the said post and the same was forwarded by the first respondent through letter dated 24.06.2025 to the third respondent for further consideration.

While keeping the said application pending, the post that fell vacant on 30.06.2025 was filled up by transferring one Mr.Vijayakumar, who is stated to be far junior to the petitioner in gross violation of the relevant rules / regulations, which provide procedures for transfer. It is aggrieved by the same, the petitioner approached this Court by filing a writ petition in W.P. (MD) No.

Court. While so, the petitioner is stated to have submitted yet another application on 06.01.2026 to the respondents requesting for his transfer to the post of Special Grade Foreman in Thirumangalam, where the said post is going to fell vacant shortly due to the superannuation of the incumbent employee, namely, Mr.Arivalagan. The said application dated 06.01.2026 submitted by the petitioner is still pending consideration. Under those circumstances, the petitioner, having failed in his attempt on the earlier occasion, has approached by this Court by filing the present writ petition anticipating that the respondents may not consider his application for transfer and any of his juniors may be posted at Thirumangalam.

5. Mr.B.Ramanathan, learned Standing Counsel, appearing for the respondents submitted that the respondents would consider the request made by the petitioner through application dated 06.01.2026 duly taking into consideration the relevant rules and regulations governing the request for transfer.

6. In the light of the above, without going into the merits of the matter, this writ petition is disposed of directing the respondents to take immediate action on the application dated 06.01.2026 submitted by the

petitioner seeking transfer to the post of Special Grade Foreman in the vacancy that is likely to arise shortly on superannuation of the incumbent Mr.Arivalagan working in the Office of the Assistant Engineer, Thirumangalam Town / Section, Thirumangalam Division, Madurai, as expeditiously as possible, at any rate, within a period of six weeks from the date of receipt of a copy of this order. No costs.
