For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. PRAYER :- For Anticipatory Bail in Crime no.51 of 2021 on the file of the respondent Police.
ORDER : The Court made the following order :- Apprehending arrest at the hands of the respondent police for the alleged offences punishable under sections 147, 148, 294(b), 307, 324, 506(ii) I.P.C, on the file of the respondent police, the petitioners have come forward with this petition seeking anticipatory bail.
2.It is seen from the submissions made that due to previous enmity, the petitioner and other accused said to have unlawfully assembled and attacked the defacto complainant with long knife, at about 5.45 a.m, on 03.04.2021. As a result, the defacto complainant suffered serious injuries and therefore, this case came to be registered under Sections 147, 148, 294(b), 307, 324, 506(ii) I.P.C. https://hcservices.ecourts.gov.in/hcservices/
3.The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case.
4.The learned Government Advocate (criminal side) strongly opposed this petition on the ground that the first petitioner has eight previous cases pending against him, including one 302 I.P.C case and two 307 I.P.C cases and one case registered under the Arms Act and other cases are offences under Indian Penal Code. The second petitioner has five previous cases pending against him, including one 302 I.P.C case, one 307 I.P.C case and other cases are offences under Indian Penal Codes. Earlier the bail petition, filed by the petitioners, was dismissed on 19.04.2021. There is no change of circumstance to entertain this petition. Considering all these aspects, this Court is not inclined to grant anticipatory bail to the petitioners.
