For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.224/2021 on the file of the respondent police ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 147, 294(b), 397, 506(ii) IPC in crime No.224 of 2021 on the file of the respondent police, seek bail.
2.The case of the prosecution is that the defacto complainant is having 7 shops in Nagercoil and the first petitioner is the tenant for three shops. The defacto complainant asked the first petitioner to vacate the shop and the first petitioner refused for the same for the reason that the first petitioner deposited huge amount. On 23.04.2021, all the accused persons threatened the defacto complainant by stating that if he gave Rs.20 Lakhs, the first petitioner will vacate the shops, due to the same, the defacto complainant gave a sum of Rs.13,50,000/-. Hence, the complaint. 3.The learned counsel for the petitioners would submit that the petitioners are innocent and they have been falsely implicated in this case.

CRL OP(MD)No.6500 of 2021 4.The learned Government Advocate(Crl.Side) appearing for the respondent police strongly opposed this petition on the ground that the investigation in this case is at preliminary stage. 5.Considering the above facts and circumstances of the case and also the fact that the investigation in this case is at preliminary stage, this Court is not inclined to grant Anticipatory bail to the petitioners. Accordingly, this criminal original petition is dismissed.
