O R D E R

This Criminal Original Petition has been filed seeking a direction to the 2nd Respondent to depute a Competent Officer for re-investigation in Crime No.17 of 2013 on the file of the 3rd respondent and to file a final report before the jurisdictional Magistrate within a time frame.

2.Mr.T.C.Vijayakumar, the learned counsel for the petitioner would submit that as per the direction of this Court in Crl.O.P.(MD)No.8765 of 2015, the petitioner has filed an application dated 31.10.2015, under Section 173(8) Cr.P.C. seeking re-investigation, however, the application is not yet numbered and disposed of.

3.The learned Government Advocate (Criminal Side), on instructions, would submit that the case is taken on file by the Chief Judicial Magistrate, Thoothukudi in S.C.No.308 of 2015 and the case is now posted for trial on 29.11.2016. https://hcservices.ecourts.gov.in/hcservices/

4.Considering the submissions made by the learned counsel for the petitioner and the learned Government Advocate (Criminal side), the Chief Judicial Magistrate, Thoothukudi is directed to number the petition filed on 31.10.2015, in S.C.No.308 of 2015, if it is in order and pass suitable orders as expeditiously as possible.
