Respondent PRAYER : Criminal Revision Case filed under Section 397 and 401 of Cr.P.C., to call for the records pertaining to the judgment passed by the learned II Additional District and Sessions Judge, Thoothukudi, in C.A.No.71 of 2018 vide judgment dated 28.02.2019 in so far as it relates to remitting the aforesaid case to the trial Court is concerned and while confirming the conviction awarded by the learned Judicial Magistrate, Sathankulam, Thoothukudi District, in C.C.No.139 of 2005 vide judgment dated 12.01.2019 in so far as it relates to the quantum of punishment awarded to the respondent under Section 138 of Negotiable Instruments Act and set aside the same and consequently impose maximum punishment upon the respondent as provided in the said penal provision along with a direction to pay compensation to the value of double the cheque amount.

ORDER

When the matter is taken up for hearing today, the learned counsel appearing for the petitioner submitted that the matter has already been settled between the parties and he received the entire cheque amount and hence, seeks permission of this Court to withdraw this Criminal Revision Case and he has also made an endorsement to that effect.

2. Considering the submissions made by the learned counsel for the petitioner, permission is granted. Accordingly, this Criminal Revision Case is dismissed as withdrawn.
