ORDER

Mr.R.Saravana Prabhu reports that pursuant to the undertaking given on 01.04.2026, the civil revision petitioner has withdrawn I.A.Nos.2 of 2024 and 3 of 2025 in A.S.No.13 of 2024.

2. Mr.H.Lakshmi Shankar states that after withdrawing those two applications, the petitioner/appellant has represented another application to file an additional written statement in the final decree proceedings.

3. When this aspect was pointed out to Mr.R.Saravana Prabhu, he has filed a memo stating that the civil revision petitioner will not pursue the unnumbered application represented yesterday. The said memo is scanned and extracted hereunder:

4. The learned Additional District Judge, Fast Track Court, Nagercoil is requested to record the aforesaid memo and reject the petition, if represented by the petitioner.

5. As the decks have been cleared for taking up the appeal, the learned Additional District Judge, Nagercoil is requested to take up A.S.No.13 of 2024 by advancing the hearing from 24.04.2026 to 15.04.2026. Both the counsel for the petitioner and the respondents are agreeable for the said advancement of hearing in appeal. The learned Additional District Judge shall hear the appeal on 15.04.2026 and pronounce the judgment on or before 15.06.2026. The warrant of delivery with respect to Item 1 alone will be kept in abeyance till 15.06.2026 or till the date of pronouncement of the judgment in the appeal, whichever is earlier.

6. With the above directions, this Civil Revision Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
