PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the 2nd respondent to enquire and dispose of the petitioner's appeal No.8459/2026/D1, dated 23.02.2026 and subsequently mutate the patta in his name based on the registered sale deed document No. 1530/2025, dated 25.02.2025 within the time limit as fixed by this Court. O R D E R
This petition has been filed seeking to direct the 2nd respondent to enquire and dispose of the petitioner's appeal No.8459/2026/D1, dated 23.02.2026 and subsequently mutate the patta in his name based on the registered sale deed document No.1530/2025, dated 25.02.2025 within the time limit as fixed by this Court.
2. The learned counsel for the petitioner submitted that the petitioner purchased the property from one Muthaiah through a registered sale deed bearing Doc. No. 1530 of 2025 dated 25.02.2025 and has since been in possession and 2/6
enjoyment of the same. It was later discovered that the fifth respondent, Vignesh, had submitted a representation dated 24.03.2025 to the third respondent seeking cancellation of the patta standing in the name of the petitioner's vendor, Muthaiah. Pursuant to this, the third respondent initiated proceedings, issued notice to the fifth respondent, and, after obtaining a report from the fourth respondent, cancelled the patta in the name of Muthaiah. Consequently, the patta was transferred to the names of Karupathevar, S/o Mayathevar, and Manjikaman @ Chinnaiagh, S/o Kamathevar. It is further contended that the third respondent passed the said order without issuing any notice or affording an opportunity of hearing to the petitioner. Aggrieved by the same, the petitioner has preferred an appeal before the second respondent in Appeal No. 8459/2026/D1, which is presently pending.
3.Heard the learned Government Advocate appearing for the respondents 1 to 4.

4. Considering the above facts, the second respondent is directed to consider the appeal and dispose of the same after issuing notice to the petitioner and the 5th respondent within a period of six months from the date of receipt of a copy of this order.
