PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a writ of Mandamus to direct the 1st respondent to act upon the recommendation of the ICC Report, finalize the same and pass orders within a period as fixed by this Court as there is already time laps in acting upon the report as per the said Act within the Prescribed period of 60 days under section 13(4) of the POSH Act forthwith and thus render justice. ORDER
The relief sought for in the present writ petition is to direct the first respondent to act upon the recommendations of the Internal complaints committee, finalise the same and pass appropriate orders.
2. The learned counsel for the petitioner made a submission that a complaint was given against the petitioner regarding sexual harassment in work place and an internal complaints committee was constituted and the charges against the writ petitioner are held not proved. However, no further action has been taken by the respondents in this regard.
3. This Court is of the considered opinion that in respect of other grievance, the petitioner has to approach the competent authority for redressal. If at all the orders of suspension is to be reviewed or further actions are to be taken regarding the service conditions, the petitioner has to submit appropriate application and in the event of submitting any such representation, the authorities have to consider the same on merits and in accordance with law.
4. With this observation, the writ petition stands disposed of. No costs.
