Maha Sivarathiri on 26.02.2025 despite of direction in W.P.(MD) No. 5751 of 2024 dated 08.03.2024 based on the complaint dated 20.03.2025, within the time frame fixed by this Court.

O R D E R

This writ petition has been filed by the petitioner to direct the respondents no.1 to 3 to take appropriate action against the respondents no.4 to 6 for illegally restraining the petitioner from performing pooja and to offer prayer in "Arulmigu Angala Parameswari Amman Thirukovil, Manachanallur, Trichy District", on the auspicious occasion of Maha Sivarathiri on 26.02.2025 based on the complaint dated 20.03.2025.

2. According to the petitioner, he is the devotee of "Arulmigu Angala Parameswari Amman Thirukovil, Manachanallur" and the private respondents no.4 to 6 have restrained the petitioner from worshiping the God and thereby, he approached this Court in W.P.(MD) No.5751 of 2024 and this Court also passed an order by directing the respondents therein to Page No. 2 of 6

permit the petitioner to offer his prayer during the Maha Sivarathiri Festival. While so, the petitioner based on the Court order went to the Temple for offering his worship and the same was restrained by the respondents no.4 to 6. To that effect, he has also filed a contempt petition in Cont.P.(MD) No.719 of 2025, wherein this Court directed the petitioner to approach the concerned police by lodging a complaint dated 20.03.2025, but the same has not been considered. Hence this petition.

3. The learned counsel appearing for the respondents no.4 to 6 would submit that the allegations levelled against the respondents no.4 to 6 are false and these respondents have never restrained the petitioner from worshiping the Temple.

The learned Additional Public Prosecutor (Criminal Side) appearing for the respondents no.1 to 3 would submit that based on the complaint given by the petitioner dated 20.03.2025, they conducted enquiry and closed the same as the petitioner not even went for worship to the Temple and the respondents no.4 to 6 have also denied the alleged restrains made by them and also they have not breached the order of the Court.

Since the complaint of the petitioner dated 20.03.2025 was already considered and closed after enquiry and the prayer of the petitioner is also to take action on the complaint of the petitioner, nothing survives for further adjudication in this matter. Recording the above said submission of the respondents, this Writ Petition is closed.
