Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents 1 to 3 to disburse the amount in respect of the Life Insurance Policies taken by the Petitioner's husband bearing Nos.782525590 - Rs. 1 lakh, 744108554 - Rs.1.50 Lakhs, 744108555 - Rs.1.50 Lakhs, 744109439 - Rs.1.75 Lakhs, 744109440 - Rs.1.75 Lakhs, 744109441 - Rs.1.50 Lakhs and 783567819 - Rs.5 Lakhs to the legal heirs of the deceased (Late) Magendran @ Mohammed Yasin, Muslim, as per the provisions of Hanafi Law (Mohammedan Law) by considering the representation sent by the Petitioner dated 24.10.2014 For Petitioner :M/s.K.Mahendran For Respondents :M/s G.Prabhu Rajadurai 1 to 3 For Respondents : M/s.J.M.Hassanul Bazari 4 and 5

ORDER

Heard both sides.

2.Before Mediation, the parties have arrived at the following agreement/settlement and the details of the same are as under: ''The Petitioner A.Farhana's husband is no more. They have one female child Ayesha Suhaila, aged 6 1⁄2

years. The Petitioners Father-in-Law P.Gana Sekaran @ Amanullah, Respondent No.4 and Mother-in-Law Sornam @ Anisha, Respondent No.5, are senior citizens. The Petitioner has one LIC Policy for Rs.5,00,000/- Policy No.783567819. The Respondent No.4 has 3 policies amounting to Rs.4,05,000/- vide Policy No.744109439, 744109440, 744109441.

The Respondent No.5 has 3 LIC Policies to the amount of Rs.4,00,000/- vide Policy No.782525590, 744108554, 744108555.

The husband has G.P.F and Gratuity which is given to his wife/Petitioner.

1.The Petitioner/wife is the eligible person for her insurance amount Rs.5,00,000/-.

2.Similarly the Father-in-Law and Mother-in-law (Respondent No.4 and 5) will take the amount of Insurance in their name.

3.The G.P.F and Gratuity to the husband of the Petitioner should come to the Petitioner and she will deposit the amount in the name of the Minor Girl. 4.The Respondent No.4 and 5 are fully agreeable to this settlement.

5.There shall be no further demand or claim from each other parties.''

3.In view of the aforesaid agreement/settlement arrived at between the parties, recording the same, this Court disposes of the Writ Petition. There shall be no order as to costs. It is made clear that the Mediation Report, dated 21.07.2015 shall form part and parcel of this order. No costs.
