Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of Mandamus to direct the 2nd respondent to appoint the petitioner as Village Administrative Officer in the existing vacancies as per reserve list III phase published based on the written examination held on 20.02.2011 and notification dated 21.07.2010.

Mr.D.Muruganantham, learned Additional Government Pleader, takes notice for the 1st respondent and Mr.K.P.Krishnadoss, learned Government Advocate, takes notice for the 2nd respondent.

2. By consent, the writ petition is taken up for final disposal.

3. The petitioner seeks for a mandamus directing the 2nd respondent to appoint her as Village Administrative Officer in the existing vacancies as per reserved list phase - III published based on the written examination held on 20.02.2011 pursuant to the Notification dated 21.07.2010.

4. The case of the petitioner is as follows:

The petitioner participated in the written test conducted for the post of Village Administrative Officer and she has become successful in the written test. Thereafter, the respondents published the results and called upon the petitioner to attend the certificate verification on 28.10.2014 and for counseling on 29.10.2014. However, due to Dengue fever suffered by the petitioner at the relevant point of time, she could https://hcservices.ecourts.gov.in/hcservices/

not attend the certificate verification as well as counseling. Therefore, the petitioner made a representation on 17.11.2014 requesting for another counseling for the petitioner. As the representation is not considered so far, the present writ petition is filed for the relief as stated supra.

The learned counsel for the petitioner submitted that though the petitioner has sought for a mandamus directing the 2nd respondent to appoint her as Village Administrative Officer, it would suffice, if a direction is issued to the 2nd respondent, since there are unfilled vacancies to the post of Village Administrative Officer as on today, to consider the petitioner's representation dated 17.11.2014 and pass orders on the same, taking into consideration of all the above stated facts and circumstances.

Accordingly, this writ petition is disposed of with a direction to the 2nd respondent to consider the representation of the petitioner dated 17.11.2014 and pass orders on the same on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order. No costs.
