RFL/THENI/6/2026 Dated 09th March 2026 and quash the same as illegal and consequently direct the 3rd Respondent to Register Petitioner document in Survey No.125 (Re-Survey) No.125/17 in Plot No.89 with an extent of 920 Square Feet of Vacant site comprised in Veerapandi Village, Theni Taluk and District and pass such other or further orders as this Honble Court may deem fit and proper in the nature and circumstances of the case and thus render justice. 1/4

ORDER

The writ petition is filed challenging the Impugned Refusal Check Slip dated 09.03.2026.

2. Heard Mr.M.Beema Rao, learned counsel appearing for the petitioner and Mr.A.Baskaran, learned Additional Government Pleader, who takes notice on behalf of the respondents.

3. A perusal of the record reveals that the Impugned Refusal Check Slip dated 09.03.2026 has been issued stating that the documents have to be uploaded on the web portal after duly obtaining a temporary number.

4. It is the grievance of the petitioner that while attempting to upload the document, upon clicking the survey numbers, the document is rejected on the ground that the survey number belonging to the petitioner is incorrectly shown as Government Interest Land.

5. In view thereof, the writ petition is disposed of on the following terms:- 2/4

i. The impugned Refusal Check Slip dated 09.03.2026 is not a Refusal Check Slip, but merely a directive to the petitioner to upload the document online;

ii. In view of the difficulty expressed by the petitioner, the SubRegistrar shall conduct an enquiry, after issuing notice to the petitioner and the appropriate revenue authorities, to determine whether the land in question belongs to the petitioner or is classified as Government Interest Land.

iii.Based on the outcome of such enquiry, further orders shall be passed in accordance with the judgment of the Hon'ble Division Bench of this Court in the case of Sudha Ravi Kumar and another vs. The Special Commissioner (HR & CE) (W.P. No. 30589 of 2012, etc., batch.

iv. Upon passing of such order, it shall be open to the aggrieved party to prefer an appeal, if so advised, in accordance with law. v. No costs.
