PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents to consider the representation of the petitioner dated 22.03.2024 and provide police protection and also permission for putting up audio systems and lighting facilities for their village temple festival which is scheduled to be conducted from 06.05.2024 to 09.05.2024.

O R D E R

Seeking Mandamus to grant permission and to provide adequate police protection for putting up audio systems and lighting facilities for their village temple festival, which is scheduled to be conducted from 06.05.2024 to 09.05.2024, the petitioner has filed this writ petition.

2.The learned counsel for the petitioner submits that the petitioner is one of the Trustees of Durgaiamman Temple, Vilathikulam Taluk, Tuticorin District. They have decided to celebrate a festival in the temple from 06.05.2024 to 09.05.2024. Seeking permission for putting up audio systems and lighting facilities in the temple to celebrate the festival and also to conduct cultural programmes, the petitioner has submitted a representation to the respondents on 22.03.2024. The respondents have given permission orally. However, without the written consent, the festival and the related cultural programmes could not be conducted peacefully.

3.Mr.T.Senthil Kumar, learned Additional Public Prosecutor, who takes notice for the respondents submits that due to the present election and in order to avoid any untoward incidents and law and order issues, the request of the petitioner for conducting cultural programme could not be considered.

4.In view of the submission made by the learned Additional Public Prosecutor that in view of the ensuing election, the request of the petitioner could not be considered, this writ petition is disposed of with a liberty to the petitioner to approach the concerned Assistant Returning Officer.
