PRAYER: Civil Revision Petition filed under Article 227 of the Constitution of India, to direct the Court below to dispose of the pending C.P. No. 121/2012 on the file of the Labour Court, Tirunelveli within the time that may be fixed by this Court.

ORDER

Heard Mr. D.Kamachi Learned Counsel for the Petitioner and Mr. C.Karthikeyan, learned Counsel for the Respondents and perused the materials placed on record, apart from the pleading of the parties. 2.

This Civil Revision Petition under Article 227 of the Constitution of India has been filed to expedite the disposal in C.P. No. 121 of 2012 on the file of the Labour Court, Tirunelveli (hereinafter referred to as the 'Trial Court' for short).

This Court, during earlier hearing on 18.04.2024, had passed the following order:- "2.

The Labour Court, Tirunelveli shall send a report as to whether there is any impediment for conducting further proceedings in C.P. No. 121 of 2012 and if so, explain the reasons for the same, before the next hearing."

In furtherance to the said order, the Trial Court has sent a report dated 23.05.2024, which reads as follows:- "I humbly submit that CP 121/2012 was ripe of Enquiry on 06.02.2013. But thereafter I.A. No. 113/2013 was filed and the same was allowed on 21.03.2014 and as against the said order appeal has been preferred and further proceedings was stayed till 2017 and thereafter case was posted for enquiry. The petitioner was examined on 05.07.2018 and he was cross examined on 11.12.2019. 3/6

Chief Examination of RW1 was recorded on 13.04.2022 and RW1 was not yet cross examined and petitioner is getting time for cross examination of RW1 repeatedly despite appearance of RW1 for few hearings. Since the case pertains to Tuticorin District and I was placed incharge as FAC for Labour Court, I used to attend Camp Court only on 3rd Wednesday of every month. Despite the case was posted for cross of RW1, neither the petitioner nor Respondent appeared before this court for the hearings to proceed with the case further. If RW1 was cross examined on the side of petitioner and further proceedings were progressed by both side, there is no impediments in disposing this case as early as possible."

On perusal of the above, there shall be a direction to the Labour Court, Tirunelveli, to dispose of the C.P. No. 121 of 2012, within a period of one year from the date of receipt of a copy of this order. 4/6

In the result, the Civil Revision Petition is disposed on the aforesaid terms. No costs.
