ORDER
Heard Mr. D.Kamachi Learned Counsel for the Petitioner and Mr. C.Karthikeyan, learned Counsel for the Respondents and perused the materials placed on record, apart from the pleading of the parties. 2.
This Civil Revision Petition under Article 227 of the Constitution of India has been filed to expedite the disposal in I.D. No. 53 of 2013 on the file of the Labour Court, Tirunelveli (hereinafter referred to as the 'Trial Court' for short).
3.
This Court, during earlier hearing on 18.04.2024, had passed the following order:- "2.
The Labour Court, Tirunelveli shall send a report as to whether there is any impediment for 2/6
conducting further proceedings in I.D. No. 53 of 2013 and if so, explain the reasons for the same, before the next hearing."
4.
In furtherance to the said order, the Trial Court has sent a report dated 15.05.2024, which reads as follows:- "I humbly submit that I.D. 53/2013 was ripe of Enquiry even on 05.02.2014. But thereafter I.A. No. 46/2014 was filed and the same was allowed on 21.03.2014 and as against the said order appeal has been preferred and further proceedings was stayed till January 2018 and thereafter case was posted for enquiry. But the petitioner did not get alongwith enquiry and marked documents till January 2024 and thereafter documents were produced and marked on both side and posted for arguments on preliminery issue. Since the case pertains to Tuticorin District, and I was placed incharge as Full Additional Charge for Labour Court, I used to attend Camp Court 3/6
only on 3rd Wednesday of every month and after hearing of arguments case was posted for order on preliminary issue and thereafter reopened for clarification regarding the preliminary issue aspect and both side yet to address this court on the point of clarification and once both side addressed this court the case can be reserved for orders on preliminary issue and if both side agreed to contest the case on merit there is no impediment in final disposal of this case once both parties let in evidence on merit." 5.
On perusal of the above, there shall be a direction to the Labour Court, Tirunelveli, to dispose of the I.D. No.53 of 2013, within a period of one year from the date of receipt of a copy of this order. In the result, the Civil Revision Petition is disposed on the aforesaid terms. No costs.
