PRAYER :- For Bail in Cr No.1/2023 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner/A4, who was arrested and remanded to judicial custody on 01.02.2023 for the offence punishable under Sections 5(l),5(j)(ii)r/w.6(l) of POCSO Amendment Act,2019 and 506(i) of IPC in crime No.1 of 2023 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the petitioner herein had committed penetrative sexual assault on the minor victim girl and also threatened her not to disclose the same to anyone, hence the case.
3. Heard both sides and perused the materials available on record including the First Information Report and also the statement of the victim recorded under section 164 of Cr.P.C.
4. On perusal of the statement recorded under section 164 Cr.P.C it is revealed that the petitioner herein is aged about 38 years and the victim is aged about 15 years. When she was proceeding to her house, the petitioner pulled her and committed penetrative https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.6297 of 2023 sexual assault on her. The petitioner who is married man had committed very serious and heinous offence as against the minor victim girl, hence this Court is not inclined to grant bail to the petitioner.
5. Hence the petition stands dismissed.
