ORDER

The present writ petition has been filed to challenge the impugned order, dated 24.03.2025 passed by the 2nd respondent vide Na.Ka.No.22/CO/SVG/2025 and consequently, direct the respondents to grant permission and adequate protection for conducting Adal Padal cultural programme scheduled on 29.03.2025 between 07.00 p.m. to 10.00 p.m., on the event of Panguni Pongal at Sembanur Village, Sivagangai Taluk, Sivagangai District.

2. According to the petitioner, he is one of the Committee Member for the temple festival. During the event of Panguni Pongal, they have decided to conduct Adal Padal Programme on 29.03.2025. In this regard, they have sent a representation to the 2nd respondent to grant permission to conduct cultural programme and to provide police 2/6

protection and the same was rejected on 24.03.2025 by citing the reason that there are chances for law and order problem. Hence, this petition. However, the petitioner is undertakes to conduct cultural programme without any law and order problem.

3.The learned Additional Public Prosecutor appearing for the respondents would submit that the representation given by the petitioner was rejected by the 2nd respondent vide impugned order, dated 24.03.2025 by citing the law and order problem. Hence, prays to dismiss the petition.

4.This Court had heard both sides and perused the materials available on record.

5.The main grievance of the petitioner is that they have decided to conduct Adal Padal Progamme on the eve of Panguni Pongal festival on 29.03.2025. However, the respondent police rejected the request of the petitioner by citing law and order problem. 3/6

6.Since the Adal Padal Programme is one of the cultural programme, the 2nd respondent cannot deny permission only on the ground of law and order issue. Therefore, the impugned order is liable to be quashed.

7.In view of the above, the impugned order, dated 24.03.2025 is set aside and the 2nd respondent is directed to grant permission by imposing necessary conditions to conduct Adal Padal Programme on 29.03.2025 on the eve of Panguni Pongal at Sembanur Village, Sivagangai Taluk, Sivagangai District and to monitor the programme. The petitioner is also directed to ensure that the cultural programme be conducted without any law and order issue and without any obscene acts.

8.With the above said observations and directions, this petition stands disposed of. Consequently, connected miscellaneous petition is closed.
