PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus forbearing the respondents herein from in any way developing the Horticulture activities in respect of the land comprised in S.No. 196/2 measuring an extent of 0.50.00 ares which is situated at Kallikudi Village Group, Paramakudi Taluk, Ramanathapuram District, which was earmarked as a Burial Ground by considering representation dated 22.06.2020 submitted by the petitioner and his villagers. [Order of the Court was made by S.M.SUBRAMANIAM, J.] The writ on hand has been instituted forbearing the respondents from in any way developing the Horticulture activities in respect of the land comprised in S.No.196/2, measuring an extent of 0.50.00 ares, which is situated at Kallikudi Village Group, Paramakudi Taluk, Ramanathapuram District, which was earmarked as a burial ground, by considering the representation dated 22.06.2020 submitted by the petitioner and his villagers.

2. Today, when the matter is taken up for hearing, learned

Government Pleader appearing for the respondents, on instructions, submitted that burial ground is situated in Survey No.196/2, however horticulture activities are carried on only in Survey No.197. Furthermore, the burial ground is situated away from the farms wherein the horticulture activities are carried on and to substantiate the said contention, he has produced photographs before this Court.

3. In view of the above submission, no further consideration is required in this writ petition, and the same is, accordingly, disposed of. No costs. Consequently, connected miscellaneous petition is closed. [S.M.S., J.] [A.D.M.C., J.] 23.07.2025 NCC :
