PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the second respondents to register a case based on the petitioner's complaint dated 31.05.2018.

ORDER

According to the petitioner, he made a complaint before the respondent police, against the proposed accused. But, so far, no action has been taken on the said complaint. Hence, the petitioner is before this Court with the aforesaid prayer. 2.The learned Government Advocate (Crl.Side) appearing for the respondents would submit that enquiry is still pending with the second respondent.

3.Considering the fact that the enquiry is still pending with the second respondent, the second respondent is directed to conduct enquiry and the enquiry reveals any cognizable offence, upon notice to the proposed accused, the second respondent shall register the complaint and if there is no cognizable offence made out, the second respondent shall drop further proceedings. A copy of the closure report shall also be communicated to the parties concerned. 4.This Criminal Original Petition is disposed of with the above direction.
